Education Contract

We, the mother and partner, if applicable (“We” or “Client”), have decided to pursue childbirth, parenting or newborn education classes provided by King of Prussia Doulas (“KOPD”). The aforementioned parties agree as follows:

This contract (“contract”) is made between the undersigned participant and King of Prussia Doulas (“KOPD”), the provider of the classes.

Classes provided by KOPD are intended to help expectant parents learn about and prepare for labor and birth or breastfeeding and the newborn period. The classes are an education series that will take place as described on the website. Unlike traditional classes, the series will be tailored to suit the needs of the students in the class.

NOW, THEREFORE, In consideration of the promises and mutual covenants herein contained, you, the Client and KOPD hereby agree as follows:

I. Limitations/Disclaimer
The classes provided by KOPD are for informational purposes only and do not provide medical advice. The classes offer health related information but are designed for non-commercial, informational purposes only. YOU SHOULD NOT RELY ON THIS INFORMATION AS A SUBSTITUTE FOR, NOR DOES IT REPLACE, PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT. IF YOU HAVE ANY CONCERNS OR QUESTIONS ABOUT YOUR HEALTH OR THE CONTENT PROVIDED IN THE CLASSES, YOU SHOULD ALWAYS CONSULT WITH A PHYSICIAN OR OTHER HEALTH-CARE PROFESSIONAL. YOU SHOULD NOT DISREGARD, AVOID OR DELAY OBTAINING MEDICAL OR HEALTH RELATED ADVICE FROM YOUR HEALTH-CARE PROFESSIONAL BECAUSE OF SOMETHING YOU LEARNED THROUGH THE CLASSES. THE USE OF ANY INFORMATION PROVIDED IN THE CLASSES IS SOLELY AT YOUR OWN RISK.
Nothing stated in the class intended to be, and must not be taken to be, the practice of medicine or counseling care. Client’s attendance at the class does not create in any way a physician/patient, confidential, or privileged relationship, or any other relationship that would give rise to any duties on KOPD’s part. KOPD does not recommend or endorse any specific tests, physicians, clinics, procedures, opinions, or products. If YOU rely on any of the information provided by KOPD, our employees, contractors, guests or visitors, YOU do so solely at your own risk.

III. Investment
The cost of the classes is due at the signing of this contract. If you require the split fee, please let us know at the time of signing this contract. If you have purchased a KOPD Birth Package, the fee is covered as outlined in that contract.

IV. Refunds & Cancellations
Payment of the Fee in accordance with the above will reserve your place in the class. Due to the limited space available for attendance, if you choose to cancel six weeks prior to the scheduled date for Class, an administrative fee of $65 will be retained. The remainder of the Fee will be returned. If you cancel less than six weeks prior to the scheduled date for Class, the full Fee is non-refundable. In the event of illness, injury, or attendance of a birth by the instructor, all efforts will be made to send a substitute instructor from KOPD; or as possible, an additional class will be scheduled as soon as possible. In the event of severe weather, in person classes will be rescheduled as soon as possible. In the event of power outages or technological difficulties on the part of KOPD, classes will be rescheduled as soon as possible.

V. Disclaimer of Warranty
THE SERVICES PROVIDED AND MADE AVAILABLE TO YOU PURSUANT TO THIS AGREEMENT ARE RENDERED “AS IS” AND KOPD SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. YOU WILL NOT HOLD KOPD OR ITS AFFILIATES LIABLE OR RESPONSIBLE FOR THE ACTIVITIES OF KOPD OR INFORMATION LEARNED IN THE CLASSES. YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE INDEPENDENTLY DECIDED THAT THE SERVICES ARE APPROPRIATE FOR THE PURPOSES FOR WHICH YOU INTEND, AND THAT YOU DID NOT RELY ON ANY SKILL OR JUDGMENT OF KOPD IN SUCH SELECTION.

VI. Limitation of Liability
IT IS UNDERSTOOD AND AGREED THAT KOPD’S LIABILITY FOR ANY DAMAGES SUFFERED BY YOU, WHETHER IN CONTRACT, IN TORT, UNDER ANY WARRANTY THEORY, IN NEGLIGENCE, OR OTHERWISE SHALL BE LIMITED TO THE MINIMUM AMOUNT ALLOWED BY PREVAILING LAW. NOTWITHSTANDING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL KOPD BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES OF YOU OR ANY THIRD PARTY OR OTHERWISE ARISING OUT OF THIS AGREEMENT, EVEN IF KOPD HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

VII. Release
You hereby release from all claims, damages or suits and agree that you will in no way hold KOPD, its employees, affiliates and contractors, including the instructor of the Classes and the hosting location of the Classes (“Released Parties”) responsible for (1) any complications that could arise as a result of your pregnancy, labor or the delivery of your child; and/or (2) any and all injuries you may sustain at the hosting location of the Classes. You further agree that neither you nor any member of your family, will make any claim or initiate any suit against any of the Released Parties now or at any time in the future. In signing this contract, you acknowledge and agree that you have read, understand and agree to all the terms set forth herein.
